1. Eligibility and acceptance
By creating an account or using TALK, you confirm that you are at least 18 years old and can enter into these Terms. You must not use TALK if you are under 18 or if you are prohibited from using the service under applicable law.
2. Accounts and authentication
You are responsible for providing accurate account information, protecting your credentials, and activity on your account. Use only your own account and promptly contact us if you believe it has been compromised. We may require email verification or take reasonable steps to protect account security.
3. Your conduct
You must use TALK lawfully and respectfully. You may not violate these Terms or the Community Standards, infringe rights, disrupt the service, evade enforcement, or use TALK to harm people. You remain responsible for your speech and conduct in rooms.
4. Rooms, hosts, and moderators
Rooms are live voice conversations. Hosts and moderators may set reasonable room rules and use available controls to manage participation, including approving speakers, muting, removing participants, or ending a room. These controls do not replace TALK's enforcement decisions, and hosts and moderators may not use them abusively or discriminatorily.
TALK may limit room access or participation to protect users, enforce these Terms, or operate the service. Do not assume a room, speaker role, or account feature will always be available.
5. Reports and human moderation
You may report conduct you believe violates our rules. Reports and relevant service information may be reviewed by authorized human reviewers. A report is not a finding of wrongdoing, and TALK does not promise a particular outcome or response time. We may investigate, preserve relevant records, and take action we reasonably consider appropriate.
6. Service availability and changes
We work to provide a reliable service, but TALK may be unavailable, interrupted, changed, or discontinued. We may update features, rules, or these Terms when reasonably needed. If we make material changes, we will post updated Terms with a new effective date and provide additional notice when required.
7. Suspension and termination
We may suspend, restrict, or terminate access when we reasonably believe it is necessary for safety, security, legal compliance, service integrity, or enforcement of these Terms or the Community Standards. You may stop using TALK at any time. Provisions that by their nature should continue, including responsibility for conduct and dispute-related provisions, survive termination.
8. Disclaimers and liability
TALK is provided on an “as available” basis. To the extent permitted by law, we do not guarantee uninterrupted, secure, error-free, or suitable service, and we are not responsible for user speech or conduct. Nothing in these Terms excludes liability that cannot legally be excluded. To the extent permitted by law, TALK's liability for claims related to the service is limited to direct damages up to the greater of amounts you paid to TALK for the service in the prior 12 months or US $100.
